IP Alert: USPTO Continues to Revise Rules of Practice

The U.S. Patent and Trademark Office (USPTO) is in the process of entering major revisions to the rules of practice to reflect the changes required by the Leahy-Smith America Invents Act (AIA). As we reported in July, the USPTO issued proposed rules relating to the first-to-file and third-party submission provisions of the AIA (see our earlier alerts here and here).
In the past week, the USPTO announced final rules to implement the post-patent provisions of the AIA and also announced final rules relating to disciplinary proceedings for attorneys and agents.
Fitch Even attorneys are monitoring the new rules packages and will provide periodic reports and updates.
