Yesterday, the Court of Appeals for the Federal Circuit ordered en banc hearing in Robert Bosch LLC v. Pylon Manufacturing Corp. The questions presented for review concern 28 U.S.C. § 1292, one of the paths for interlocutory appeal. Specifically, the court will decide en banc whether this statute confers jurisdiction to entertain appeals from patent infringement liability determinations where a trial on damages has not yet occurred, or where willfulness issues are outstanding and remain undecided.
