Today, in Teva Pharmaceuticals USA, Inc. v. Sandoz, Inc., the U.S. Supreme Court issued an important opinion relating to patent claim construction. The Court held that an appellate court must apply a “clear error” standard of review, not a de novo standard of review, when reviewing the “evidentiary underpinnings” of a district court’s claim construction. This case will be significant in many respects in future appeals to the Federal Circuit.
