The U.S. Patent and Trademark Office (USPTO) today announced proposed rules relating to the conduct of proceedings before the Patent Trial and Appeal Board (PTAB). Among other proposed changes, the rules would allow a patent owner to submit evidentiary materials in its preliminary response to a petition to institute inter partes review proceedings. The rules also would require a Rule 11-type certification for all papers filed with the PTAB, with a provision for sanctions for noncompliance.
